Kathleen’s practice focuses on insurance coverage matters. For many years, she has represented insurers in both the United States and London markets as coverage and monitoring counsel, specializing in claims under various types of insurance policies, including directors and officers, fidelity, employment practices, fiduciary liability, professional liability, general liability, and excess policies. She has extensive experience assessing the coverage afforded under these policies to insureds for all forms of civil litigation, including securities litigation, shareholder derivative suits, governmental investigations, employment practices claims, civil rights claims, ERISA and other benefit-related claims, professional malpractice claims, and general commercial litigation.
Serving as monitoring counsel, Kathleen maintains contact with defense counsel and insureds regarding litigation status and strategy throughout the course of underlying litigation, and provides insurers with on-going analysis of their insureds’ potential liability and damages, as well as advice regarding the insurers’ potential exposure under their policies. She also monitors defense counsel fees and costs, negotiates allocation agreements regarding defense costs and settlements, and represents insurers at settlement conferences and mediations.
Kathleen has also served as defense counsel in cases involving insurance bad faith claims asserted against insurers by their insureds and/or third-party claimants, and has provided advice to insurers on an array of insurance bad faith issues.
