Colleen Hennessey Prevails in Daubert Hearing

Drug and Medical Device Litigation: Colleen Hennessey was recently successful in excluding the testimony of a plaintiff’s causation expert who sought to opine that a prescription medication is a cause of inflammatory bowel disease. Following a four-day hearing before the District Court of Douglas County Nebraska, the court found that plaintiff’s gastroenterology expert “has maintained an arguably financially lucrative opinion and does not reassess the validity of those conclusions as new evidence has developed. Rather, as it appears from the evidence before this Court, he defends the conclusions by shifting the underlying premise to justify his current extrapolated conclusion to fit the facts of the case.” This win is the latest in a series of significant victories that Peaboby & Arnold’s drug and medical device attorneys have achieved on behalf of a major pharmaceutical manufacturer.
