Terri L. PastoriPARTNER Ms. Pastori represents clients in complex litigation matters, including professional liability, employment, construction and surety, commercial, and intellectual property disputes. She defends lawyers, insurance brokers, and other professionals against claims of malpractice in both the state and federal courts. Through careful strategy and persistence, she has successfully obtained judgments in favor of clients prior to trial. For example, the United States Court of Appeals for the First Circuit upheld the entry of summary judgment in favor of Ms. Pastori's client, an insurance broker, on a claim that the broker did not advise the insured to obtain additional liability insurance. The Massachusetts Superior Court awarded judgment in favor of Ms. Pastori's client on claims of legal malpractice stemming from the settlement of a personal injury suit, and the New Hampshire Supreme Court upheld a trial court's decision to grant Ms. Pastori's motion to dismiss a legal malpractice lawsuit brought by a convicted felon against her client and the plaintiff's former criminal defense attorney for wrongful conviction. Ms. Pastori's employment practice primarily focuses on counseling and representing employers in employment matters, such as employee discipline, terminations, investigations, policies and procedures, training, and the defense of claims of discrimination, harassment, failure to accommodate, retaliation, and breach of employment and collective bargaining agreements, and ERISA violations. She also advises clients on protecting intellectual property, including the negotiations and enforcement of non-compete and non-disclosure agreements with their employees. She has represented employers in federal and state courts, the state administrative agencies in Massachusetts, New Hampshire, Maine, and Rhode Island, and before the Equal Employment Opportunity Commission. Ms. Pastori also represents sureties, developers, and contractors in construction disputes and bond claims (including surety and fidelity bonds) and has represented the Surety & Fidelity Association of America as an amicus curiae in matters in the New Hampshire Supreme Court and the Massachusetts Appeals Court. She represents clients in commercial litigation disputes, including breach of contract cases, partnership and shareholder disputes, and claims for breaches of fiduciary duties.
